If FHWA follows the advice of P3 experts, a tightly focused and carefully drafted set of best practices aimed at educating states on how to capture the P3 value proposition in contracts for highway DBFOM concessions will emerge from the agency a year from now, as required by Congress.
That will be just in time to meet a requirement of MAP-21 for FHWA to develop “standard public-private partnership transaction model contracts for the most popular types of public-private partnerships” within 18 months of the bill’s passage.
